【美国进口清关】2025年11月10日美国对中国加征的芬太尼关税&对等关税更新情况介绍

美东时间 2025 年 11 月 10 日起，美国对中国加征的芬太尼关税由 20% 降至 10%，中国（包括香港和澳门）对等关税 10% 加征不变，另外的 24% 再次暂停实施，为期 1 年，直至 2026 年 11 月 10 日。

中美《吉隆坡经贸磋商》

当地时间 2025 年 10 月 25 日至 26 日，中美在马来西亚吉隆坡举行经贸磋商，围绕相关经贸问题达成成果共识，其中，关税方面，美方将取消针对中国商品（包括香港特别行政区和澳门特别行政区商品）加征的 10% 所谓“芬太尼关税”，对中国商品（包括香港特别行政区和澳门特别行政区商品）加征的 24% 对等关税将继续暂停一年（在此暂停期间，现行的 10% 对等关税将继续有效）。

在 2025 年 3 月 3 日发布的第 14228 号行政命令（EO 14228）《进一步修改针对中华人民共和国合成阿片类药物供应链的关税》（Further amendment to duties addressing the synthetic opioid supply chain in the people’s republic of china）中，美国将经修订的第 14195 号行政命令中规定的额外从价税率从 10% 提高到 20%（芬太尼关税）。

美东时间 2025 年11 月 7 日下午 2:34（PM）美国海关和边境保护局 CBP 发布 CSMS # 66749380 公告，旨在就根据 2025 年 11 月 4 日发布的总统行政令（EO 14358）“根据美国与中华人民共和国之间的经济贸易安排，修改对等关税税率”（Modifying reciprocal tariff rates consistent with the economic and trade arrangement between the united states and the people’s republic of china）及同样于 2025 年 11 月 4 日发布的行政令（EO 14357）“修改针对中华人民共和国合成阿片类药物供应链的关税”（Modifying duties addressing the synthetic opioid supply chain in the people’s republic of china）修改的关税税率（Tariff rate）提供指导。

IEEPA 对等关税（IEEPA Reciprocal）

美国协调关税表 HTSUS 第 99 章第 III 子章注释 2(v) 项下税号 9903.01.63 及第 (xvii)(10) 分项（Heading 9903.01.63 and subdivision (xvii)(10) of U.S. note 2(v) to subchapter III of chapter 99）将继续暂停执行征收，直至美国东部标准时间 2026 年 11 月 10 日凌晨 00:01。根据 2025 年 4 月 2 日第 14257 号行政命令（Executive order 14257）（《通过对等关税规范进口，以纠正造成美国每年商品贸易逆差持续存在且巨大的贸易行为》及其修订版）（Regulating imports with a reciprocal tariff to rectify trade practices that contribute to large and persistent annual united states goods trade deficits），凡于美国东部标准时间 2026 年 11 月 10 日凌晨 00:01 之前进口用于消费（Entered for consumption）或从仓库提取用于消费（Withdrawn from warehouse for consumption）的中国进口商品（包括香港和澳门进口商品），将继续适用 10% 的从价对等关税（Reciprocal tariff of 10% ad valorem）。申报人应按以下方式申报此类产品：

9903.01.25：除税号（Headings）9903.01.26–9903.01.33、9903.02.02–9903.02.71 和 9903.96.01 中描述的产品外，以及除税号 9903.01.34 和 9903.02.01 中规定的产品外，任何国家生产的商品，均应按美国协调关税表 HTSUS 第 99 章第 III 子章注释 2(v)（U.S. note 2(v) to subchapter III of chapter 99 of the HTSUS）的规定，加征 10% 的附加从价关税（Additional ad valorem duty rate of 10%）。

IEEPA 中国芬太尼（IEEPA China Fentanyl）

自 2025 年 11 月 10 日起，根据经修订的第 14195 号行政命令（EO 14195, as amended），中国和中国香港特别行政区商品的从价关税税率（Ad valorem duty rate）由 20% 降至 10%。对于美国东部标准时间（EST）2025 年 11 月 10 日凌晨 00:01 或之后进口用于消费（Entered for consumption）使用或从仓库提取用于消费（Withdrawn from warehouse for consumption）的中国和中国香港特别行政区商品，将适用以下美国协调关税表 HTSUS 分类（HTSUS classification）及附加关税税率（Additional duty rate）：

9903.01.24：除税号（Headings）9903.01.21、9903.01.22 和 9903.01.23 项下的产品外，所有来自中国和中国香港特别行政区的进口商品，以及除美国协调关税表第 99 章第 III 子章美国注释 2(u) 中（U.S. note 2(u) to subchapter III of chapter 99 of the HTSUS）规定的随身行李中包含的个人使用产品外，将额外加征 10% 的从价关税（Additional ad valorem rate of duty of 10%）。

不符合豁免条件的中国和中国香港特别行政区商品仍需缴纳 IEEPA 对等关税（IEEPA reciprocal tariffs）和 IEEPA 芬太尼关税（IEEPA fentanyl tariffs）规定的额外从价关税，以及任何其他适用的关税。
