【美国进口清关】反倾销产品：厨房电器搁架及置物架和反倾销税令产品范围（A-570-941）

所有用于厨房电器内部、尺寸在规定范围内的金属架类结构（包括配套支撑件和滑轨系统），例如冰箱内金属架、烤箱架和冷冻设备搁架，基本都在反倾销税令 A-570-941 涵盖的产品范围，除非其支撑面是玻璃。

背景（Background）

2008 年 7 月 31 日，美国商务部 DOC 收到了一份关于来自中国某些厨房电器搁架和置物架（Certain kitchen appliance shelving and racks）进口的反倾销税申诉。该申诉由以下主体提交：

• Nashville Wire Products Inc.
• SSW Holding Company, Inc.
• United Steel, Paper and Forestry, Rubber Manufacturing, Energy, Allied-Industrial and Service Workers International Union
• International Association of Machinists & Aerospace Workers, District 6

根据经修订的《1930 年关税法案》第 732(b) 条（Section 732(b) of the Tariff Act of 1930, as amended）的规定，申诉方指称来自中国进口的某些厨房电器搁架和置物架正在或可能正在美国市场以低于《1930 年关税法案》第 731 条（Section 731）所指的公平价值（Less Than Fair Value, LTFV）的价格销售，并且该类进口产品正在对美国相关产业造成实质性损害，或构成实质性损害的威胁。2008 年 8 月 27 日，美国商务部启动反倾销调查。

2008 年 9 月 22 日，美国国际贸易委员会 ITC 发布了肯定性初步裁定（Affirmative preliminary determination），认定有合理迹象表明，由于从中国进口的涉案商品，美国相关产业遭受了实质性损害（Materially injured）。2009 年 3 月 5 日，美国商务部发布初步裁定，认定自中国进口的某些厨房电器搁架和置物架正在或可能正在美国以低于公平价值的价格销售。调查期 POI 为 2008 年 1 月 1 日至 2008 年 6 月 30 日。根据《1930 年关税法案》第 733(f) 条（Section 733(f)）的规定，美国商务部 DOC 将把其关于低于公平价值销售的初步裁定通知美国国际贸易委员会 ITC。如果最终裁定为肯定性裁定，ITC 将在该初步裁定之日起 120 天内或最终裁定之日起 45 天内（以较晚者为准）裁定涉案商品的进口是否对美国产业造成实质性损害或构成实质性损害的威胁。

2009 年 7 月 24 日，美国商务部发布肯定性最终裁定。鉴于美国商务部的最终裁定为肯定性裁定（Affirmative），根据《1930 年关税法案》第 735(b)(2) 条（Section 735(b)(2) ）的规定，ITC 将不晚于该终裁作出之日起 45 天内，作出其最终裁定，即确定美国国内产业是否因涉案产品的进口而遭受实质性损害，或面临实质性损害的威胁。如果 ITC 认定不存在实质性损害或实质性损害的威胁，则该案程序将终止，且所有已缴纳的现金保证金（Cash deposits）将予以退还。如果 ITC 认定存在上述损害，美国商务部将发布反倾销税令（Antidumping duty order），指示美国海关和边境保护局 CBP 在 DOC 进一步指示下，对所有涉案产品征收反倾销税。2009 年 9 月 2 日，美国国际贸易委员会 ITC 通知美国商务部 DOC，其已做出肯定性最终裁定，认定涉案商品的进口已对美国国内产业造成实质性损害。

2009 年 9 月 14 日，基于美国商务部 DOC 和美国国际贸易委员会 ITC 作出的肯定性终裁，美国商务部正式对来自中国的某些厨房电器搁架和置物架发布反倾销税令（A-570-941）和反补贴税令（C-570-942），中国实体（China-wide entity）统一反倾销税税率 95.99%（如果中国企业未参加调查，未获得独立税率，则适用该税率）。

2025 年 9 月 2 日，根据经修订的《1930 年关税法案》第751(c) 条（Section 751(c) of the Tariff Act of 1930）的规定，美国商务部对来自中国的某些厨房电器搁架和置物架的反倾销税令启动第三次五年期复审（Five-year review）（日落复审）（Sunset Review）。2026 年 3 月 12 日，ITA 发布公告，对来自中国的某些厨房电器搁架和置物架继续实施反倾销税令和反补贴税令。

反倾销税令范围（Scope of the Order）

该反倾销税令的涵盖范围包括用于冰箱（Refrigerators）、冷冻柜（Freezers）、冰箱冷冻一体机（Combined refrigerator-freezers）、其他制冷或冷冻设备（Refrigerating or freezing equipment）、烹饪炉灶（Cooking stoves）、灶具（Ranges）和烤箱（Ovens）的搁架和置物架（Shelving and racks）（某些厨房电器搁架和置物架）（Certain kitchen appliance shelving and racks）。某些厨房电器搁架和置物架定义为搁架（Shelving）、篮筐（Baskets）、置物架（Racks）（带或不带伸缩滑轨（Extension slides），伸缩滑轨是连接到搁架、篮筐或置物架以实现滑动的碳钢（Carbon）或不锈钢（Stainless steel）五金装置（Hardware devices））、侧架（Side racks）（用于烤箱架的焊接金属丝支撑结构（Welded wire support structures），连接到烤箱腔体（Oven cavity）的内壁（Interior walls），该烤箱腔体不包含支撑肋（Support ribs）作为设计特征）以及副框架（Subframes）（与烤箱腔体内的成型支撑肋（Formed support ribs）连接以支撑使用伸缩滑轨的烤箱架组件的焊接金属丝支撑结构），其尺寸如下：

• 尺寸范围 3 × 5 × 0.10 英寸至 28 × 34 × 6 英寸之间的搁架（Shelving）和置物架（Racks）；或
• 尺寸范围 2 × 4 × 3 英寸至 28 × 34 × 16 英寸之间的篮筐（Baskets）；或
• 尺寸范围 6 × 8 × 0.1 英寸至 16 × 30 × 4 英寸之间的侧架（Side racks）；或
• 尺寸范围 6 × 10 × 0.1 英寸至 28 × 34 × 6 英寸之间的副框架（Subframes from）。

该反倾销税令涵盖商品（Merchandise）由以下材料构成：厚度 0.050 至 0.500 英寸之间的碳钢或不锈钢钢丝（Carbon or stainless steel wire）；并且可以包含：厚度 0.020 至 0.2英寸之间的碳钢或不锈钢板材（Sheet metal）。商品（Merchandise）可进行涂层处理（Coated）或不进行涂层处理（Uncoated），也可以经过成型（Formed）和/或焊接处理（Welded）。该反倾销税令的涵盖范围不包括支撑面（Support surface）为玻璃的搁架（Shelving）。

该反倾销税令涵盖商品通常归于以下美国协调关税表 HTSUS 子目项下：8418.99.8050、8418.99.8060、7321.90.5000、7321.90.6090 和 8516.90.8000。尽管列出了 HTSUS 子目（HTSUS subheadings）以供参考并便于海关操作，但美国商务部对产品范围的书面描述（Written description）才是最终决定性依据（Dispositive）。
