【美国进口清关】反倾销产品：聚乙烯零售购物袋及反倾销税令产品范围（A-570-886）

非零售购物用途的塑料袋，例如垃圾袋、草坪袋、垃圾桶内衬袋等，通常不在反倾销税令 A-570-886 涵盖的范围内。

背景（Background）

2003 年 6 月 20 日，美国商务部 DOC 收到了一份关于自中国、马来西亚和泰国进口的聚乙烯零售购物袋 PRCBs（Polyethylene retail carrier bags）的申诉，该申诉由以下企业提交：

• PCL Packaging, Inc.
• Sonoco Products Company
• Superbag Corp.
• Vanguard Plastics, Inc.
• Inteplast Group, Ltd.

根据经修订的《1930 年关税法案》第 732(b) 条（Section 732(b) of the Tariff Act of 1930, as amended）的规定，申诉方指称来自中国、马来西亚和泰国的 PRCBs 进口产品正在或可能正在美国市场以低于《1930 年关税法案》第 731 条（Section 731）所指的公平价值（Less Than Fair Value, LTFV）的价格销售，并且该类进口产品正在对美国相关产业造成实质性损害，或构成实质性损害的威胁。

2003 年 6 月 25 日，美国商务部要求申诉方就申诉中的部分内容提供补充信息和澄清，申诉方分别于 2003 年 6 月 30 日和 7 月 8 日提交了补充材料。2003 年 7 月 10 日，美国商务部启动了对来自中国、马来西亚和泰国的聚乙烯零售购物袋进口的反倾销调查。

2003 年 8 月 4 日，美国国际贸易委员会 ITC 发布了肯定性初步裁定（Affirmative preliminary determination），认定有合理迹象表明，由于从中国、马来西亚和泰国进口的涉案商品，美国相关产业遭受了实质性损害（Materially injured）。2004 年 1 月 26 日，美国商务部发布初步裁定（Preliminarily determine），认定自中国进口的聚乙烯零售购物袋正在或可能正在美国以低于公平价值的价格销售。调查期 POI 为 2002 年 10 月 1 日至 2003 年 3 月 31 日。根据《1930 年关税法案》第 733(f) 条（Section 733(f)）的规定，美国商务部 DOC 将把其关于低于公平价值销售的初步裁定通知美国国际贸易委员会 ITC。如果最终裁定为肯定性裁定，ITC 将在该初步裁定之日起 120 天内或最终裁定之日起 45 天内（以较晚者为准）裁定涉案商品的进口是否对美国产业造成实质性损害或构成实质性损害的威胁。

2004 年 6 月 18 日，美国商务部发布肯定性最终裁定。鉴于美国商务部的最终裁定为肯定性裁定（Affirmative），根据《1930 年关税法案》第 735(b)(2) 条（Section 735(b)(2) ）的规定，ITC 将不晚于该终裁作出之日起 45 天内，作出其最终裁定，即确定美国国内产业是否因涉案产品的进口而遭受实质性损害，或面临实质性损害的威胁。如果 ITC 认定不存在实质性损害或实质性损害的威胁，则本案程序将终止，且所有已缴纳的现金保证金（Cash deposits）将予以退还。如果 ITC 认定存在上述损害，美国商务部将发布反倾销税令（Antidumping duty order），指示美国海关和边境保护局 CBP 在 DOC 进一步指示下，对所有涉案产品征收反倾销税。2004 年 8 月 2 日，美国国际贸易委员会 ITC 通知美国商务部 DOC，其已依据《1930 年关税法案》第 735(b)(1)(A)(i) 条（Section 735(b)(1)(A)(i)）之规定作出最终裁定，认定自中国进口的聚乙烯零售购物袋（以低于公平价值销售）已对美国国内产业造成实质性损害。

基于美国商务部 DOC 与美国国际贸易委员会 ITC 作出的肯定性最终裁定（Affirmative final determinations），2004 年 8 月 9 日，美国商务部正式对自中国进口的聚乙烯零售购物袋发布反倾销税令，中国实体统一反倾销税税率（PRC-wide Rate）77.57%（如果中国企业未应诉参加调查，未获得独立税率，则适用该税率）。

2021 年 3 月 31 日，根据经修订的《1930 年关税法案》第751(c) 条（Section 751(c) of the Tariff Act of 1930）的规定，美国商务部对来自中国的聚乙烯零售购物袋 PRCBs（Polyethylene retail carrier bags）的反倾销税令启动第三次五年期复审（Five-year review）（日落复审）（Sunset Review）。2021 年 10 月 27 日，ITA 发布公告，对来自印度尼西亚、马来西亚、中国、中国台湾、泰国和越南的聚乙烯零售购物袋继续实施反倾销税令和反补贴税令。

反倾销税令范围（Scope of Order）

该反倾销税令涵盖的商品为聚乙烯零售购物袋 PRCBs（Polyethylene retail carrier bags），通常也被称为 T 恤袋（T-shirt sacks）、商品袋（Merchandise bags）、杂货袋（Grocery bags）或收银袋（Checkout bags）。该类商品定义为不可密封的带提手（包括抽绳）、无拉链或一体式挤压封口、带或不带侧边、带或不带印刷的聚乙烯薄膜袋，其厚度不大于 0.035 英寸（0.889 毫米）且不小于 0.00035 英寸（0.00889 毫米），长或宽均不小于 6 英寸（15.24 厘米）或大于 40 英寸（101.6 厘米）。袋子的深度可以小于 6 英寸，但不得超过 40 英寸（101.6 厘米）。

零售场所（Retail establishments）（例如杂货店（Grocery）、药店（Drug）、便利店（Convenience）、百货公司（Department）、专卖店（Specialty retail）、折扣店（Discount stores）及餐厅（Restaurants））通常会向顾客免费提供无任何消费包装的塑料购物袋，供其装载和携带所购商品。该反倾销税令商品涵盖范围不包括以下两种情况：（1）未印有任何商标或店名，且采用聚乙烯薄膜制成的抽绳封口袋；（2）以零售包装形式销售，并且印刷内容明确指向特定用途（非零售购物用途）的塑料袋，例如：垃圾袋（Garbage bags）、草坪袋（Lawn bags）、垃圾桶内衬袋（Trash-can liners）等。

该反倾销税令涵盖商品通常归类于美国协调关税表 HTSUS 子目 3923.21.0090 项下申报。该税则号同时也涵盖不属于该反倾销税令范围的产品。尽管列出了 HTSUS 子目（HTSUS subheadings）以供参考并便于海关操作，但美国商务部对产品范围的书面描述（Written description）才是最终决定性依据（Dispositive）。
