【美国进口清关】反倾销产品：回形针及反倾销税令产品范围（A-570-826）

只要是指定线径范围内、完全由贱金属线材制成的回形针，不论形状或名称，基本都会被纳入 A-570-826 反倾销税令范围内；但塑料包覆、非贱金属线材结构或特定夹具（如长尾夹、蝴蝶夹）不属于 A-570-826 反倾销税令涵盖范围内。

背景（Background）

1993 年 10 月 13 日，美国商务部收到一份由 ACCO USA Inc. 及 Noesting, Incorporated 提交的申诉，根据经修订的《1930 年关税法案》第 732(b) 条（Section 732(b) of the Tariff Act of 1930, as amended）的规定，申诉方指称自中国进口的某些回形针（Paper clips）正在或可能正在美国市场以低于《1930 年关税法案》第 731 条（Section 731）所指的公平价值（Less Than Fair Value, LTFV）的价格销售，并且该类进口产品正在对美国相关产业造成实质性损害，或构成实质性损害的威胁。1993 年 11 月 2 日，美国商务部对来自中国的某些回形针启动反倾销调查。

1994 年 5 月 18 日，美国商务部发布初步裁定，认定来自中国的回形针正在或可能正在美国市场以低于公平价值（Less Than Fair Value, LTFV）的价格销售，调查期 POI 为 1993 年 5 月 1 日至 1993 年 10 月 30 日。根据《1930 年关税法案》第 733(f) 条（Section 733(f)）的规定，美国商务部 DOC 将把其关于低于公平价值销售的初步裁定通知美国国际贸易委员会 ITC。如果最终裁定为肯定性裁定，ITC 将在该初步裁定之日起 120 天内或最终裁定之日起 45 天内（以较晚者为准）最终裁定涉案商品的进口是否对美国产业造成实质性损害或构成实质性损害的威胁。

根据经修订的《1930 年关税法案》第 735(a) 条（Section 735(a) of the Tariff Act of 1930, as amended），1994 年 9 月 30 日，美国商务部做出肯定性最终裁定。鉴于美国商务部的最终裁定为肯定性裁定（Affirmative），根据《1930 年关税法案》第 735(b)(2) 条（Section 735(b)(2) ）的规定，ITC 将不晚于该终裁作出之日起 45 天内，作出其最终裁定，即确定美国国内产业是否因涉案产品的进口而遭受实质性损害，或面临实质性损害的威胁。如果 ITC 认定不存在实质性损害或实质性损害的威胁，则本案程序将终止，且所有已缴纳的现金保证金（Cash deposits）将予以退还。如果 ITC 认定存在上述损害，美国商务部将发布反倾销税令（Antidumping duty order），指示美国海关和边境保护局 CBP 在 DOC 进一步指示下，对所有涉案产品征收反倾销税。1994 年 11 月 14 日，美国国际贸易委员会 ITC 根据该法案第 735(b)(1)(A)(i) 条，通知美国商务部其最终裁定，认定美国相关行业因涉案商品的进口而受到了实质性损害（Materially injured）。

基于美国商务部 DOC 与美国国际贸易委员会 ITC 作出的肯定性最终裁定（Affirmative final determinations），1994 年 11 月 25 日，美国商务部对来自中国的某些回形针正式发布反倾销税令（Antidumping duty order ）（A-570-826），中国实体（PRC-wide Entity）统一反倾销税税率 126.94% （如果中国企业未应诉参与调查，未获得独立税率，则适用该税率）。

根据经修订的《1930 年关税法案》（Tariff Act of 1930, as amended），美国商务部 DOC 和美国国际贸易委员会 ITC 每五年自动启动并进行复审（即日落复审（Sunset Reviews）），以确定撤销反补贴税或反倾销税令，或终止根据该法案第 704 条或第 734 条暂停的调查，是否可能导致倾销（Dumping）或可抵消补贴（Countervailable subsidy）（视具体情况而定）的继续或再次发生，以及实质性损害的继续或再次发生。

1999 年 12 月 1 日，美国商务部根据经修订的《1930 年关税法案》第 751(c) 条（Section 751(c) of the Tariff Act of 1930, as amended）的规定，发布了对中国回形针反倾销税令进行首次五年日落复审（Five-year sunset review）的通知（64 FR 67247）。

2000 年 7 月 5 日，美国商务部 DOC 根据经修订的《1930 年关税法案》第 751(c) 条和第 752 条（Sections 751(c) and 752 of the Tariff Act of 1930, as amended），认定撤销对中国回形针征收的反倾销税令，很可能导致倾销行为的继续或再次发生。2000 年 8 月 2 日，美国国际贸易委员会 ITC 根据经修订的《1930 年关税法案》第 751(c) 条，认定撤销对中国回形针征收的反倾销税令，很可能会在可预见的合理时间内导致美国相关产业继续遭受或再次遭受实质性损害。鉴于美国商务部 DOC 和美国国际贸易委员会 ITC 裁定，撤销对中国回形针征收反倾销税令很可能导致倾销行为的继续或再次发生，并对美国产业造成实质性损害，根据经修订的《1930 年关税法案》第 751(d)(2) 条，2000 年 8 月 15 日，美国商务部宣布对来自中国的回形针继续执行反倾销税令（A-570-826）。

2022 年 9 月 1 日，美国国际贸易委员会 ITC 依据经修订的《1930 年关税法案》第 751(c) 条（Section 751(c) of the Tariff Act of 1930, as amended），启动了对中国回形针反倾销税令的第五次日落复审，同时美国商务部亦启动了该项复审。 依据该法案第 751(c)(3)(B) 条以及 19 CFR 351.218(e)(1)(ii)(C)(2) 的规定，美国商务部对该反倾销税令进行了快速（Expedited）（120 天）日落复审。经复审，美国商务部根据该法案第 751(c)(1) 条和第 752(c) 条认定，如撤销该反倾销税令，可能导致倾销行为的继续或再次发生；因此，商务部将若撤销该反倾销税令时可能持续存在的倾销幅度通知了 ITC。2023 年 4 月 14 日，ITC 根据该法案第 751(c) 条和第 752(a) 条发布裁定，认定如撤销该税令，在可合理预见的时间内，可能导致美国国内相关产业继续遭受或再次遭受实质性损害。

2023 年 4 月 21 日，ITA 发布公告，鉴于美国商务部 DOC 和美国国际贸易委员会 ITC 做出裁定，撤销对来自中国的回形针的反倾销税令很可能导致倾销行为（Dumping）的继续或再次发生，并对美国国内相关产业造成实质性损害（Material injury），依据经修订的《1930 年关税法案》第 751(c) 条及第 751(d)(2) 条，商务部据此决定对来自中国的回形针继续执行反倾销税令，美国海关和边境保护局（U.S. Customs and Border Protection）将继续按报关时有效的税率对所有涉案进口商品征收反倾销税（AD）和反补贴税（CVD）现金保证金（Cash deposits）。

反倾销税令范围（Scope of Order）

该反倾销税令涵盖的产品为某些回形针（Paper clips），完全由贱金属线材制成，无论是否镀锌，也无论是否镀镍或其他贱金属（例如铜），线径介于 0.025 英寸至 0.075 英寸（0.64 至 1.91 毫米）之间，无论其物理形状如何，但明确排除的产品除外。该反倾销税令涵盖的产品可以是矩形或环形（Rectangular or ring-like shape），包括但不限于商业上称为“1 号回形针”（No. 1 clips）、“3 号回形针”（No. 3 clips）、“Jumbo’”或“Giant”回形针、“Gem 回形针”（Gem clips）、“Frictioned 回形针”（Frictioned clips）、“Perfect Gems”、“Marcel Gems”、“Universal 回形针”（Universal clips）、“Nifty 回形针”（Nifty clips）、“Peerless 回形针”（Peerless clips）、“Ring 回形针”（Ring clips）以及“Glide-On 回形针”（Glide-On clips）。

该反倾销税令明确排除塑料和乙烯基包覆的回形针（Paper clips）、蝴蝶夹（Butterfly clips）、长尾夹（Binder clips）或其他并非完全由贱金属线材（Wire of base metal）制成且已归入美国协调关税表 HTSUS 单独子目（Separate subheading）下的纸张紧固件（Paper fasteners）。

此外，Pendaflex Pile Smart Label Clips 亦被排除在该反倾销税令范围之外，该类产品并非完全由贱金属线材制成，而是由不锈钢线材与模制塑料部件以及可书写/可重复书写标签组合而成。

该反倾销税令所涉商品目前归入 HTSUS 子目 8305.90.3010。尽管列出了 HTSUS 子目（HTSUS subheadings）以供参考并便于海关操作，但美国商务部对产品范围的书面描述（Written description）才是最终决定性依据（Dispositive）。
